TERMS AND CONDITIONS
MEMBER ACKNOWLEDGES THAT MEMBER IS ACQUIRING A MEMBERSHIP FOR THE SOLE PURPOSE OF OBTAINING SOCIAL BENEFITS AND RECREATIONAL USE OF THE CLUB FACILITIES AND IS NOT AN INVESTMENT OR WITH ANY EXPECTATION OF MAKING A PROFIT FROM THE OWNERSHIP OR FUTURE TRANSFER OF THE MEMBERSHIP.

Hours of Operation. The Club’s standard hours of operation will be 10am – 8pm Monday – Friday and 10am – 5pm Saturday and Sunday. The Club’s hours of operation may vary from time to time and Members will receive notice of hours of operation that are different than standard. There are No Refunds for unused Simulator Time hours. No Exceptions.

Membership Fees. Member acknowledges and agrees he or she has been provided the details of costs and services associated with each Membership category above. Member agrees to pay the Membership Fee he or she has selected upon the fee schedule described above. Members are responsible to ensure that their method of payment is current and updated at the time monthly Membership Fees are charged. Member agrees to be responsible for all charges incurred by Members, their families and guests in their use of Club Facilities.

Late Fees. Member agrees to pay all Membership fees on or before the due date thereof. Member understands that delinquency in paying any amounts due may result in late charges, interest on the amount past due until paid at a rate determined by Club Operator (not to exceed 18% per annum), Club Operator charging all amounts due to the Club to Member's credit card that may be on file with the Club, suspension or termination of membership privileges, and expulsion from membership in the Club. Member further agrees that if Member is delinquent in paying any amounts due, Club Operator shall be Club Operator reasonably incurs in attempting to collect the past due amounts, including, without limitation, attorney's fees and court costs, whether or not suit is filed.

Booking Simulator Time. Based on your membership level, Simulator Time may be booked up to 2 weeks in advance. Simulator Time will always start on the hour and run through the 55th minute of the hour. For example, if you have scheduled Simulator Time of 10am -11am, your Simulator Time would start at 10am and end at 10:55am. Arriving promptly and starting Simulator Time on time and exiting Simulator Time on time is the responsibility of the Member and essential for smooth operation of Club Facilities. No refunds or carryovers for unused minutes of Simulator Time.

Member Use – Concurrent Simulator Time. If Members decide to use Simulator Time concurrently with another Member, the Club Operator will alternate Simulator Time between the Members. For example, Member A books the Simulator Time and Member B joins for the first hour. Only Member A is charged for Simulator Time for the first hour. For the second hour, if both Member A and Member B are using the Simulator concurrently, only Member B will be charged for the second hour, unless the Members decide otherwise.

Use of Putting Green: For 12-Month memberships, use of the putting green is unlimited. For the 6-Month or 3-Month memberships, use of the Putting Green will be tied to a Member’s booking of Simulator Time. The 3-Month or 6-Month Member and his or her guests will be able to use the putting green within 2 hours (front or back) of scheduled Simulator Time.

Guest Policy and One-Time Technology Fee. Membership categories of all levels will have the opportunity to bring up to 3 guests when Simulator Time is booked. Guests will charged a daily guest fee of $25 and will be subject to a $25 Technology Fee. Guest play will be deducted from the Member’s Simulator Time. All Guests will be required to sign our Guest Agreement and accept all Club rules and policies. Members are responsible for all Guest charges and actions while using Club Facilities, including damage of Club Facilities. No unaccompanied Guests will be permitted. Members and Guests of “The Office” are not permitted to bring or consume alcohol.

Guest Policy for Junior Members: Guest fees for a Junior Member bringing an adult guest is $50 per hour. Guest fees for Junior Member bringing a junior guest (17 years and younger), is $30 per hour. All guests remain subject to the Technology Fee.

Cancellation Policy. Simulator Time reservations must be cancelled 24 hours in advance to avoid being assessed a penalty or other Club action. Members who do not abide by the 24-hour cancellation policy will be billed for 2 hours of Simulator Time. No exceptions. Club Operator reserves the right to assess additional fines for Members who fail to abide by this policy on a repeat basis.

Golf Instruction Rules. For 12-Month and 6-Month Memberships, a Member’s Simulator Time may be used for personal golf instruction using the instructor of the Member’s choice. All Club rules and regulations will apply to the instruction time; however, golf instructors will not be charged a Guest fee. Non-Members that receive instruction from an approved instructor are subject to a $25/hour Technology Fee only.

Clean Club Policy. Members are responsible to ensure that any clubs used in the simulators are clean and free of dirt and debris. The Club will provide club cleaning materials. Clubs should be cleaned prior to use of any Simulator Time.

Assumption of Risks and Indemnification. In consideration of the membership and as a condition of using the Club Facilities, Member agrees to all risks associated with the use of Club Facilities, including risks associated with use of or proximity to the Club Facilities (i.e.: being hit by a golf ball or club or falling), and agrees to release and indemnify Club Operator from and against any and all losses expenses, liens, claims, demands, and causes of action of every kind and character for death, personal injury, property damage, and other liability, damages, fines, or penalties, including but not without limitation, costs, attorney fees and settlements, whether or not based on the acts or omissions of Club Operator, resulting from, or arising out of or in any way connected to the use of the Club Facilities by Member, Member's Family members, guests, approved designees, and their family members and guests. As used in this paragraph, "Club Operator" shall include The Golf House, LLC and its respective directors, officers, shareholders, partners, members, agents, related companies, affiliates, predecessors, successors, assigns and employees, and all persons, corporations, partnerships, and other entities with which they are or may in the future become affiliated. This paragraph shall survive the termination of the Agreement and Member's membership in the Club with respect to any property damage, personal injury or death occurring prior to such termination.

Personal Property. Member, as a condition of the membership, and each Member's authorized users and guests, as a condition of the invitation to use the Club Facilities, assume sole responsibility for his or her personal property. Member acknowledges and understands that the Club Operator shall not be held responsible for any loss or damage to any personal property which Member, Member's family members, guests, approved designees, or their family members or guests may cause. If Member arranges or sponsors an activity or function on the Club premises, Member shall be responsible for any such damage or injury even if such damage or injury was not caused by the Member. Member agrees that Club Operator may charge the cost of any damages to the Member's card on file or request another form of payment.

Club Abuse Policy. Members will not incur liability for incidents of normal wear and tear on Club Facilities: however, any use or damage by a Member that is deemed by the Club Operator to be “abnormal” or “intentional” will result in expulsion from the Club and the Member will be charged all costs and expenses related to the damage caused.

No Transfer or Assignment of Membership. Member acknowledges that the membership conferred hereunder may not be pledged or assigned and is not transferrable, unless and accept as otherwise specifically set forth in the Membership Policies.

Termination of Membership. The Member can terminate this agreement at any time with written notice. The Member will still be liable for and unpaid charges due to Club. No refund of fees will be due to the Member upon termination of the Membership. The Club reserves the right to terminate a Member for any violation of Club rules and regulations, including failure to pay Membership Fees when due.

Event Rental: From time to time, the Club may be rented for special events or team instruction, causing the Club not to be available for regular Simulator Time bookings. In addition, Members that wish to rent the Club or some portion of the Club for a special event may have the opportunity to do so. Please contact admin@theohiogolfhouse.com to discuss your event and costs.
This Agreement shall not be binding unless and until the Member's Application is approved and accepted on behalf of the Club Operator as provided therein and this Agreement is executed by Club Operator or authorized representative.
PRIVACY POLICY
THE GOLF HOUSE will protect any personal information that you provide it in connection with your Membership. The personal information provided by you on this application form and the attached documents will be used to process your membership application. Failure to provide all the requested information may result in your application being rejected. You have a right to access and correct any of the personal information the Club holds about you.

The Club will not disclose your personal information to any other person or organization unless there is a legal requirement to do so. The Club may disclose some personal information about you to third parties that provide services under contract to the Club. These contracts require the third party to keep your personal information confidential and secure. An example of a third party who may have access to your information is the company that runs the Member booking engine.

Your personal information may be used by the Club for marketing purposes to improve our services and to provide you with the latest information about those services and any new related services and promotions. Notwithstanding anything else in this statement, you may, at any time, advise us that you do not wish to receive any direct marketing communication. You may do so in writing by emailing admin@theohiogolfhouse.com or by visiting our Membership Office. The opt out request will apply to all direct marketing material normally sent to you but will not apply to transactional messages about Club charges or other items directly related to your Membership.
